KLARWERK - END USER LICENSE AGREEMENT (EULA)
Version 1.0

Please read this agreement carefully before installing or using Klarwerk (the "Software"). By installing or using the Software you accept these terms. If you do not agree, do not install or use the Software.

1. LICENSE
Klarwerk (the "Publisher") grants you a free, non-exclusive, non-transferable, revocable licence to install and use the Software on computers that you own or control, for private and commercial purposes. You may pass on the unmodified installer free of charge, provided that you keep this agreement and all notices intact. You may not sell the Software, modify it, decompile or reverse-engineer it (except to the extent mandatory law expressly permits this despite this restriction), or remove copyright or trademark notices. All rights not expressly granted remain reserved.

2. WHAT THE SOFTWARE DOES - YOUR RESPONSIBILITY
Klarwerk analyzes your computer and, after your confirmation, can delete or change files, registry entries, startup settings, network settings and security settings, and can run Windows components (for example PowerShell, Windows Defender, winget, defrag and chkdsk). Klarwerk is not antivirus software and does not guarantee protection against malware.
Changes to the registry and to system settings always carry a residual risk. Microsoft does not support the use of registry cleaners. For this reason Klarwerk backs up its changes, offers to restore them (section "Backups") and tries to create a Windows restore point before system changes. These safeguards cannot rule out every problem. You decide which actions are applied and you are responsible for reviewing them beforehand. Please always keep your own backups of important data.

3. PRIVACY
Klarwerk itself does not collect, store or transmit personal data and does not connect to the internet. Settings, a log file and backups are stored only on your computer under %APPDATA%\Klarwerk. Some functions start Windows components that may contact Microsoft servers (for example winget, Windows Update and Windows Defender); Microsoft's terms and privacy statements apply to them. See the separate privacy notice.

4. NO WARRANTY
The Software is provided free of charge and "as is", without warranty of any kind, to the extent permitted by law. Statutory rights that cannot be excluded remain unaffected.

5. LIABILITY
(a) The Publisher is liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law, for fraudulently concealed defects and for any guarantee that was expressly given.
(b) In cases of slight negligence the Publisher is liable only for the breach of essential contractual obligations (obligations whose fulfilment makes proper performance possible and on whose observance you may regularly rely), and then only for the foreseeable damage typical for this type of contract.
(c) Any further liability is excluded.
(d) Liability for loss of data is limited to the typical effort of restoring the data that would have arisen if you had made regular, risk-appropriate backups.
(e) Mandatory statutory provisions remain unaffected.

6. THIRD-PARTY COMPONENTS AND TRADEMARKS
The Software contains open-source components; see "Third-party notices". Windows, Microsoft, PowerShell and Windows Defender are trademarks of Microsoft Corporation. Klarwerk is not affiliated with, endorsed by or sponsored by Microsoft or any other third party.

7. TERMINATION AND CHANGES
You may stop using the Software at any time by uninstalling it. Terms for future versions may differ; for a version you have already installed, the terms you accepted continue to apply.

8. GOVERNING LAW
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer-protection provisions of the country in which you live remain unaffected.

9. SEVERABILITY
If a provision of this agreement is or becomes invalid, the remaining provisions remain valid.

Contact details of the Publisher are published on the website from which you downloaded the Software.
